vakaymood.com charges a commission to hosts based on a percentage of the rental fee. Host payouts, less all applicable fees and commissions, are issued 2-3 days after the guest's check-in. If the guest incurs additional resort fees not disclosed by the host, those may be deducted from the host's payout. Guests are responsible for resort fees charged by the property and are advised to confirm fee details with hosts or directly with the resort.
7. Terms Specific to Hosts
Legal Obligations: By accepting a booking, hosts are legally bound to provide the accommodation described in their listing.
Cancellation Policy: If a host cancels a confirmed reservation, they must arrange similar or superior accommodations for the guest at no additional charge. vakaymood.com enforces a zero-tolerance policy for hosts who cancel without providing suitable alternatives, which may result in permanent account suspension.
Listing Information: Hosts must ensure all listing details, including fees, taxes, and resort policies, are accurate. Failure to do so may impact payouts or result in account suspension.
8. Terms Specific to Guests
Booking Obligations: By booking accommodations, guests agree to the host's terms and are responsible for understanding all associated fees, including resort fees. Any incurred damages to the property during the guest's stay will be billed to the guest.
Deferred Payment Options: Some listings may offer deferred payment options with an initial payment required at the time of reservation. It is the guest's responsibility to ensure that payment details, including card numbers and expiration dates, are accurate and up-to-date. If vakaymood.com is unable to process a deferred payment due to incorrect or expired payment information, the reservation may be canceled, and any initial deposit or payment may be forfeited.
9. Cancellations and Refunds
Host Cancellations: Hosts are responsible for selecting a cancellation policy that fits their requirements. Guests should review and agree to these policies before booking, as they will govern any cancellation.
Guest Cancellations: Cancellation policies vary by listing and are at the host's discretion. vakaymood.com is not liable for refunds beyond the agreed policy. Travel insurance is strongly recommended to cover unforeseen circumstances.
Automatic Relisting: vakaymood.com reserves the right to automatically relist any canceled reservations that fall within the cancellation period.
10. Contact and Marketing Communication Clause
10.1 By accessing or using vakaymood.com, or by voluntarily providing your contact information, you consent to being contacted by vakaymood.com and its authorized representatives through any contact method you provide, including but not limited to email, SMS, phone, messaging apps, and digital advertising platforms.
10.2 vakaymood.com may use internal systems as well as third-party tools and technologies to identify, track, and analyze user behavior on and off the platform. This includes the use of cookies, tracking pixels, device identifiers, IP address monitoring, CRM tools, and data enrichment services to personalize, segment, and deliver communications.
10.3 You agree that vakaymood.com may use this information to contact you for customer support, operational notices, marketing communications, promotional offers, retargeting, and other business-related purposes. These communications may be delivered across any existing or future communication channels and formats, as reasonably determined by vakaymood.com.

11. Damage to Property and Disputes

- Determining what taxes they are required to collect and remit.
- Complying with all applicable tax laws and regulations. Hosts are solely liable for this compliance.
vakaymood.com acts solely as a rental marketplace and does not collect or remit any lodging or occupancy taxes on behalf of hosts or guests.
13. Pricing Policy
vakaymood.com encourages competitive pricing but does not offer price matching with other listings or platforms.
14. Listing Photo Disclaimer
Please Note: Photos displayed on this listing are intended to provide a general representation of the resort and its amenities. They are not filtered by room or unit type. The images may include various room types, layouts, and features offered at the resort.
For accurate details of your specific reservation, please carefully review the unit description, which outlines the confirmed features and amenities of the unit you are booking. For example, if the unit description specifies a "partial kitchen," that is the confirmed kitchen type for your reservation, even if some photos may depict a unit with a full kitchen or other features not applicable to your booking.
By proceeding with this reservation, you acknowledge and agree to rely on the written unit description as the accurate representation of the features included in your booking.
15. Listing and Marketing
vakaymood.com reserves the right to distribute and market listings on affiliated websites to increase booking visibility. This includes, but is not limited to, listing descriptions and images.
16. Prohibited Activities
- Misrepresent their listing details, such as property type, fees, or amenities.
- Circumvent vakaymood.com's fees by transacting off-platform.
- Engage in fraudulent, discriminatory, or abusive behavior.
- Post false or misleading content or impersonate other users.
17. Term and Termination
vakaymood.com reserves the right to suspend or terminate any account that violates these Terms or poses risk to platform integrity. Suspended accounts are ineligible to re-register.
18. Disclaimer of Warranties
vakaymood.com does not guarantee uninterrupted access to the platform or the availability of properties. Guests are encouraged to verify details with hosts and the resort directly and to confirm amenities and policies in advance.
19. Limitation of Liability
vakaymood.com is not liable for damages arising from the use or inability to use the platform, including lost profits, data, or goodwill. Guests and hosts are solely responsible for their actions and any agreements between them.
20. Indemnification
Users agree to indemnify vakaymood.com from any claims or expenses arising from their use of the platform, including damages, injuries, or property loss.
21. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Delaware. All disputes shall be resolved by binding arbitration under vakaymood.com's then-current arbitration terms, which are incorporated by reference.
22. vakaymood.com's Right to Adjust Listing Details
In the event of any discrepancy between the information contained in a listing and the details of an existing confirmed reservation (including, but not limited to, reservation dates, unit type, occupancy limits, or amenities), the Host (seller) authorizes vakaymood.com to make reasonable adjustments to the listing to ensure that it accurately reflects the confirmed reservation details. Such adjustments may include, without limitation, modifications to dates, unit descriptions, or other relevant listing information to align the listing with the verified reservation confirmation. These modifications are intended to maintain accuracy, consistency, and guest confidence across the platform. Hosts acknowledge and agree that such updates made by vakaymood.com shall be deemed accurate and binding.
23. Creation of Listings on Behalf of Sellers
vakaymood.com may, at its discretion and upon request by a Host (seller), assist in creating listings on the Host's behalf. This includes, but is not limited to, the creation of multiple listings derived from data provided by the Host through spreadsheets, CSV files, or other digital means. Until automated bulk upload functionality is enabled, Hosts who submit listing data to vakaymood.com via email or file upload expressly grant vakaymood.com the right to create, modify, and publish such listings on their behalf using the information provided. Hosts remain solely responsible for the accuracy and legality of all information supplied and agree to review and confirm all listings once published. vakaymood.com assumes no liability for any errors, omissions, or misrepresentations arising from data provided by the Host.
